S1 COMPETITION-USE ACKNOWLEDGMENT AND RELEASE

PLEASE READ CAREFULLY—THIS AGREEMENT AFFECTS LEGAL RIGHTS.

I am the purchaser identified in this checkout. The “Rider” is the person identified as the Rider in this checkout.

I certify that I am at least 18 years old and that either:

• I am the Rider; or
• I am the parent or natural guardian purchasing the S1 for the identified Rider.

I certify that either the Rider already holds a current, valid IJSBA Competition Membership or an IJSBA Competition Membership is being purchased for the Rider as part of this checkout. I agree that the Rider will not operate the S1 unless and until the Rider’s IJSBA Competition Membership is current and valid.

I understand and agree that the S1 is a lightweight, high-performance competition watercraft sold solely for racing, freestyle competition, competition testing and tuning, and supervised competition practice. It is not intended for general recreational use, passengers, rental, or operation by anyone other than the identified Rider with a current, valid IJSBA Competition Membership.

I understand that stand-up watercraft racing and freestyle competition involve substantial risks, including falls, collisions, aerial maneuvers, failed tricks or landings, drowning, fire, mechanical failure, serious injury, permanent disability, and death. I knowingly accept the inherent and reasonably foreseeable risks of purchasing, owning, maintaining, testing, tuning, practicing with, and operating the S1.

I agree to ensure that the S1 is inspected before every use, that all required protective equipment and the engine-stop lanyard are used, and that operation immediately stops following any impact, hard landing, abnormal handling, damage, leak, loose component, steering or throttle problem, or suspected structural or mechanical malfunction.

I accept responsibility for unauthorized modifications, improper maintenance, prohibited use, and operation by an unauthorized person or a person without a current, valid IJSBA Competition Membership.

TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE AND DISCHARGE LEE STONE PRODUCTS, LLC; RECREATIONAL COMPOSITES, LLC; SHORT BLOCK TECHNOLOGIES, INC.; PACIFIC BIG WAVE, LLC; AND THEIR RESPECTIVE AFFILIATES, OWNERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, COMPONENT SUPPLIERS, INSURERS, SUCCESSORS, AND ASSIGNS FROM CLAIMS BELONGING TO ME FOR INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM THE INHERENT RISKS OF RACING, FREESTYLE, OR OTHER COMPETITION USE, OR FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY RELATING TO THE DESIGN, MANUFACTURE, ASSEMBLY, IMPORTATION, DISTRIBUTION, TESTING, SALE, INSPECTION, INSTRUCTIONS, WARNINGS, SERVICING, MAINTENANCE, OR OPERATION OF THE S1.

NOTICE CONCERNING MINOR RIDERS

If the Rider is under 18, I certify that I am the Rider’s parent or natural guardian and authorize the Rider to engage in this potentially dangerous activity.

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF LEE STONE PRODUCTS, LLC; RECREATIONAL COMPOSITES, LLC; SHORT BLOCK TECHNOLOGIES, INC.; AND PACIFIC BIG WAVE, LLC USE REASONABLE CARE, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BECAUSE CERTAIN DANGERS ARE INHERENT IN STAND-UP WATERCRAFT RACING AND FREESTYLE COMPETITION AND CANNOT BE AVOIDED OR ELIMINATED.

BY AGREEING TO THIS FORM, YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE PARTIES IDENTIFIED ABOVE FOR PERSONAL INJURY, INCLUDING DEATH, OR PROPERTY DAMAGE RESULTING FROM RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO AGREE TO THIS FORM, AND LEE STONE PRODUCTS, LLC HAS THE RIGHT TO REFUSE TO SELL THE S1 FOR USE BY YOUR CHILD IF YOU DO NOT AGREE.

To the fullest extent permitted by Florida law, I accept on behalf of myself and the minor Rider the inherent risks of stand-up watercraft racing, freestyle competition, competition testing, tuning, and supervised practice, and release the parties identified above from claims resulting from those inherent risks.

This agreement does not waive any claim that applicable law does not permit to be waived.

I certify that the purchaser and Rider information entered during checkout is accurate and that the Rider either currently holds a valid IJSBA Competition Membership or an IJSBA Competition Membership is being purchased for the Rider as part of this checkout. I have read, understand, and agree to this entire S1 Competition-Use Acknowledgment and Release, and I understand that checking this box constitutes my electronic signature.
